Terms and Conditions
Happy Holiday Homes, a registered business name of Maid Cleaning Pty Ltd ACN 631150706, acts as “the booking agent” for the Owner of the Property. Short stay reservations are accepted by Happy Holiday Homes (HHH), a registered business name of Maid Cleaning Pty Ltd as agent for the Owner of the Property and to which bookings the following terms and conditions shall apply:
Rental Contract
The rental contact is between the Guest and the Owner of the Property for which the accommodation short stay booking is made and is subject to the terms and conditions herein. The Guest acknowledges that the Booking Agent acts as a booking agent for the Owner only and not as a principal. HHH enters into this agreement on behalf of the owner of the property and is not liable to you in relation to the property or any services.
Failure to comply with any of the Guest's fundamental obligations and the terms and conditions of the property may result in immediate termination and eviction. The guest is granted a licence to occupy the accommodation for the agreed booking period only.
HHH reserve the right to revoke or refuse to honour any holiday accommodation booking, at any time before or during the holiday rental period, which may in their opinion (and at their sole discretion) be unsuitable for the property.
Noise & Neighbours
Please respect your neighbours who work and have young kids, no noise or music after 10pm. If your behaviour has a negative impact on your neighbours and this will impact our ability to rent this house to other guests in the future. A call out fee of $200 will apply if our management or security company are called out to investigate a noise complaint. A subsequent noise complaint or a complaint attended by police will likely result in your eviction from the property and loss of your bond.
Number of Persons, Parties and Functions
Properties are for guests only. No outside guests are permitted on the premises. The number of occupants must not exceed the number of persons shown on your confirmation. Shire regulations allow holiday homes to be rented for accommodation purposes only and not as a function venue (For example a wedding or party). Functions and gatherings are not permitted and, if evidenced, may be closed down immediately and will likely result in your eviction from the property and loss of your bond.
Check-in and Check-out
Check-in is available from 3pm on the day of arrival. Check-out is by 10am on the day of departure.
Leavers / Schoolies
Sorry, but leavers are not permitted to stay at any property where HHH is acting as an agent – we recommend using an approved accommodation only (see the leavers website/app) as your safety and enjoyment will be carefully planned.
Animals and Pets
Pets not accepted unless stated otherwise in the specific home description. Where pets are permitted they may not be left unattended at any time.
Utilities
Neither HHH nor the Owner of the Property can be held responsible for failure or interruption to power or services to the property for reasons beyond our control.
Excess Cleaning
HHH requests guests to leave the property as it was found to avoid extra cleaning charges. This includes washing dishes, placement of rubbish in the bins provided and cleaning of the BBQ. The cleaners will strip the beds and will clean the floors so this is not required by the guests, however cleaning charges may apply if the walls, floors, windows and/or linen are excessively dirty.
Rubbish Collection and Excess Rubbish
HHH requests guests put all rubbish in the appropriate bins provided outside no later than the night before collection (rubbish collection day is indicated in the property information guide located at the property on the kitchen table or work surface).
If the bins are not put out or if there is excess rubbish upon check out, a private contractor maybe organised to empty the bins and charges will be deducted from bond.
Damages and Charges
The Guest shall be responsible for the Property during the Guest’s stay. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition. The Guest shall be liable for any breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest’s occupation of the Property and all costs for extra cleaning, repair and replacement thereof shall be payable to the Booking agent or the Owner from the Guest Security Bond. Any such costs over and above the amount taken as a Guest Bond may be sought by the Owner or the Owner’s insurance company through the Local Court. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the HHH as soon as practicable after the damage occurs.
Guest’s Property
All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and neither the HHH nor the Owner accepts any responsibility for any loss or damage.
Property Presentation
The description of the premises and services is given in good faith. From time to time, changes occur at properties, sometimes by owners and outside of HHH control or knowledge therefore no responsibility for irregularities will be accepted.
Building Works
Many of the properties managed by HHH are in suburban locations where, from time to time, there may be building / construction or roadworks within the nearby vicinity of the property booked. HHH Stays take no responsibility for any issues relating to constructions or roadworks.
Availability of Property
The short-term accommodation contract negotiated by the Booking Agent and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control of the Booking Agent which render the Property uninhabitable (for example flood, fire, storm, tempest, etc) or the property becomes for sale or is sold by the Owner, then the Booking Agent may have to cancel the Guest’s booking for the Property. Should such circumstances arise then the Booking Agent will endeavour to relocate the Guest to a holiday home of a similar standard to the property in the same area. Where this is not possible, the Booking Agent will refund all monies paid by the Guest in respect of the Property. Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner of the Property or the Booking Agent.
Disclaimer
A condition of entering and/or staying at this property means that all guests understand and agree to indemnify the agent (HHH) and Property Owner(s) against any responsibility or action(s) (legal or other), due to any action(s), incident(s), loss or injury(s) while within or outside of the premises (including, but not limited to, the grounds, facilities, structures, etc.) during a stay or at any other time.
To the extent permitted to by law HHH will not be liable for losses arising as a result of this agreement whether such losses arise as a result of HHH negligence or otherwise.

Deposit, Final Payment, Cancellations and Changes.
Applies to bookings made directly with HHH, either by phone, email or via our website - https://happyholidayhomes.com.au/.
[Please note that bookings via online travel agents (AirBNB, Stayz, Booking.com, etc.) are subject to payment terms and cancellation policies of those agents and are beyond the control of HHH.]
Deposit
The accommodation booking will not be confirmed by the Booking Agent until the Guest’s deposit payment is received and cleared. The deposit is 30% off the accommodation fee. If the accommodation booking is made within four weeks of the date of commencement of the Guest’s proposed holiday, the full rental payable for the Property is required together with any bond, cleaning fee, credit card information and any other payment applicable.
Final Payment
The full amount payable in respect of the Property rental shall be paid at least four weeks prior to the date of commencement of the booking. If the full payment has not been received by the Booking Agent at least four weeks prior to the start of the rental period, then the Booking Agent and the Owner reserve the right to cancel the booking without notice and the Guest will forfeit the Guest’s deposit which will be non-refundable in such circumstances.
Cancellation
Once your booking has been confirmed and deposit received, your deposit is non-refundable. If the booking is cancelled more than 30 days from the date of commencement of your holiday you will be released from the liability for the full balance of hire. The deposit is non-refundable. Cancellation within four weeks of the date of commencement of your holiday will result in the loss of the full accommodation fee – but not the cleaning fee or any bond. 15-29 days prior to arrival date the cancellation fee is 50%
Changes to Holiday Bookings
Changes to holiday bookings dates are regarded in the same way as cancellations.
Insurance
Plans change, life happens - HHH recommends that the Guest takes out comprehensive holiday cancellation and protection insurance with a reputable insurance company to cater for any unforeseen circumstances which may arise including accident, ill health or any other matters beyond the Guest’s reasonable control, as once the booking has been made and confirmed, the Guest will be responsible for payment of the full rental whether or not occupation of the Property occurs.
Name changes
HHH recognise that Guests may have to forfeit their bookings for reasons beyond their control, as above – to offer a potential solution, should a Guest be able to sell on their stay, “name changes” are not charged. The new Guest is subject to the same terms and conditions set out above in entirety.
